Protective Filing

A protective filing date is the date an individual notifies the SSA of an intention to file for benefits. While it can be the date an individual files for benefits, it can also be be established by a prior written or verbal contact by phone, mail, or in-person or online. The SSA can take months or years to approve a claim, so the protective filing date will help establish your eligibility so that if an individual is granted disability benefits, they can receive retroactive benefits, or backpay, for the period in which they were diagnosed with a medically-qualifying conditions but not yet approved for benefits.
